BREXIT – WHAT THAT MEANS FOR REGISTERED TRADE MARKS & DESIGNS


For now it is business as usual but over time, it will have an impact on registered trade marks and designs. National registrations will be unaffected by the UK leaving the EU. But there will be inevitable change to EU trade marks and EU designs that are administered by the EU Intellectual Property Office. Once we have formally left the EU, applications for EU trade marks and EU designs will no longer cover the UK. We are informed by our Trade Mark attorneys that instead applications needing protection in the UK will need to file separate national applications. For existing EU trade marks and EU design registrations in the UK it is expected that they will be maintained by some form of re-registration process.
